set out important information regarding your rights, obligations and the
restrictions that may apply when you use our online services (which may
include streamed audio visual content, text, photographs, forums,
advertising, classifieds and other services) (“Services”) at the website
www.itvlocal.com (the “Website”). We recommend that you read them
carefully before using the Services.
These Terms of Use govern the relationship between you
and ITV Consumer Limited when you access and use our Services. Any
reference to “you” or “your”, means you as user of the Website and
Services, any reference to “we”, “us”, “our” or “ITV” is to ITV Consumer

By accessing and continuing to use the Services, you
agree to be legally bound by these Terms of Use. Please note that we may
update and amend these Terms of Use from time to time and any changes will
be posted on the Website. However, it is your responsibility to ensure you

by ITV via the Services (excluding any Submissions by users (in respect of
which see below)) shall remain at all times the property of ITV or ITV's

the ITV group, our partners or third parties and our/their products and
services contained in the Services are proprietary marks and may not be
reproduced or otherwise used without express permission.

is the intellectual property of Microsoft Corporation and third party
suppliers. Any copying, republication or redistribution of such Microsoft
content, including by cacheing, framing or similar means, is expressly
prohibited without the prior written consent of Microsoft. Additional

Your Submissions: If you wish to submit any contribution to the
Services or upload any content on the Website, such as any text (including, for
instance, on any chat rooms or forums or on any classified pages), photographs,
graphics, video or audio (“Submission”), you agree that unless and to the extent
specifically stated otherwise on the Website any Submission you make to the Services,
is subject to the following additional terms:
You retain all ownership rights in any Submission you may make. You promise that
you are the original owner of any Submission you make or you have the necessary
licences, rights, consents, and permissions to authorise us to use your Submission.
In particular, you promise that you have obtained the permission of all of the people
featured or referred to in the Submission (and if they are under 18 their parents
or guardians as well) to our use of the Submission on the Services. You agree to

damage or loss caused to you where such damage or loss is not reasonably
foreseeable to you and us when you agree to these Terms of Use (which
occurs automatically when you access and continue to use the Services),
including where the damage or loss results from our breach of these Terms
of Use; We do not accept liability for any damage or loss caused to you
where you are not entering into these Terms of Use as a
consumer.
We do not guarantee which Services will be on the
Website. All Services on the Website are provided on an 'as is' and 'as

Terms and Conditions for ITV News (“ITV”)
1. These Terms
and Conditions shall apply to you if you choose to send to ITV MMS
photographs, pictures and/or video footage of you or another person either
using your own or another person's mobile phone or e-mail for use in the
ITV News programme (the “Programme” which shall include any re-edited
re-formatted or compilation versions of the Programme known by any
title). 2. Viewers can send a photo, picture or video via: (i) a MMS
text message to the number 63332 containing their photo, name and
location, with the following keyword as the first word of the message

internet access arrangements. 3. By sending us your photo, you agree
that ITV can broadcast, publish and edit the photo and pass it onto others
for similar use by all means and in any media worldwide in perpetuity,
without any payment being due to you. Please do not submit your
contribution unless you accept this. 4. You must own the copyright of
any photo you submit. 5. You must get the permission of all the people
shown in the photo before submitting it. If the photo features children
aged under 16, you must get the permission of their parents also. If the
photo is taken on private property (e.g. inside someone’s house), you must
get the permission of the owner of the property. 6. You should not
endanger yourself or others, take any unnecessary risks or infringe any
laws to obtain photos. 7. You should not submit photos of any artworks,
photos or other copyright works, any logos or other commercial references,
or anything that might reasonably be deemed to be harmful or
offensive. 8. By sending us your photo you warrant that its use by ITV
will not breach another person’s privacy, copyright or any other legal
right. 9. Photos, pictures and videos received will be judged by staff
in the relevant ITV News room, who will then select which photos, pictures
and videos (if any) to broadcast. 10. In the event of any fault,
mistake, misunderstanding or dispute concerning the operation of the mode
of entry the decision of ITV shall be final and no correspondence will be
entered into.
11. The mode of entry may, from time to time, be
affected by events outside our control. ITV accepts no responsibility for
any failure to accept/send entries due to network performance or due to
any other event outside our control or for entries that are incomplete or
incomprehensible. ITV makes no guarantee of MMS or other access to the
service. 12. By submitting a photo, you agree to your name being used
in publicity by ITV and to participate in such publicity as required. This
can be in any media worldwide without notice or without any fee being
paid.
13. ITV accepts no liability for any loss or
damage howsoever arising from the submission of your photo whether due to
any error, omission or other cause by us, our employees, agents, or others
to the fullest extent permitted by law. Save for death or personal injury
arising from our negligence or fraudulent misrepresentation the maximum
amount of our liability to you in any circumstances shall be the amount
paid by you and received by us due to the submission of your photo. 14.
Personal data which is provided by you as an entrant when you enter will
be held and used by ITV plc and its suppliers and contractors in order to
administer the use of the picture and contact the entrant if necessary.
Entrants' personal data may also be passed to their cellular phone
provider or to relevant regulatory bodies, the police or other authorities
in the course of the investigation of any complaints or suspected unlawful
activity or where requested by the phone provider in connection with the
billing arrangements for the competition. Aggregate, non personal data may
also be used for the purpose of undertaking market research or in
facilitating reviews, developments and improvements to relevant
services. 15. MMS entrants may also be offered the opportunity to
subscribe to ITV’s mobile services. Before doing so, entrants should refer
to the Terms and Conditions and Privacy Policy at www.itv.com/itvi.
16. These Terms and Conditions shall be exclusively governed by and
construed in all respects in accordance with the laws of England and Wales
and entrants irrevocably submit to the exclusive jurisdiction of the
courts of England and Wales in respect of any matter arising
hereunder.

WEATHER IDOL VOTING TERMS AND CONDITIONS
Viewers can vote by email only.
Viewers can vote for which weather idol contestant that
they feel should win.
There is no charge for email entries.
You may vote as many times as you like.
The voting window is opened and closed as specified on
the “Central News (East)” programme. Votes made or received outside of
these specified times will not be counted. Voting times are liable to
change and ITV may suspend, withdraw or re-set voting at its sole
discretion at any time.
ITV and the producers of the programme
reserve the right to discount votes if they have reasonable grounds to
suspect that fraudulent voting has occurred.
ITV, its subsidiaries, the producers of the programme
and their sub-contractors do not accept any responsibility whatsoever for
any technical failure or malfunction or any other problem with any
telephone network or line, system, server, provider or otherwise which may
result in any vote being lost or not properly registered or recorded.
The result of the vote will be from all votes received
by the producer of the programme into the studio at the time when the
result is calculated, after the voting window has closed. Please note that
votes which have been sent but not yet received by the producer of the
programme at the time when the result is calculated will not be counted,
even if the voter has received an acknowledgment of sent message.
ITV will NOT have a say in the outcome, the winner will
be the person who receives the most votes.
The contestant who receives the most votes will be the
winner and will receive a 6 month part time contract as a weather
presenter with Central Tonight.
Guidelines for Voting by Email - To vote for a weather
idol contestant, you may send an email, to the email address as displayed
on the programme.
QUERIES/COMPLAINTS
If you have a query about voting, you may register your
query on the night with the ITV duty office who can be contacted by phone
on 0870 600 6766 or by email at dutyoffice@itv.com. You will need to give
the following information:
1. Your Name. 2. The email address you sent your
email from. 3. The time(s) you sent your email when you experienced
problems. 4. If possible, your Internet Service Provider. 5. A
contact telephone number. 6. Please confirm the email address you sent
your email to. Alternatively, you may send the above required
information to itvihelp@itv.com and we will contact you as soon as
possible.
Queries will be addressed as soon as possible
after the show has broadcast.
